Members of the PEC #800435 (DEC #216, Desnianskyi district) were re-writing protocols right in the DEC. They had blank stamped and signed forms with them.
Members of the DEC #216 (Desninskyi district) informed OPORA's observer abou illegitimate actions committed by members of PEC #800435, who were rewriting protocols blank stamped and signed forms. According to the CEC, this precinct commission was ordered to correct the protocols for the third time. Members of the DEC called the police and drew up a report.
According to the Article 95(8) of the Law of Ukraine on Elections of People's Deputies of Ukraine, members of a PEC shall come back to the precinct and correct a protocol: The precinct election commission shall, within the time framework determined by the district election commission, consider the issue of introducing changes to the respective protocol without re-counting the ballot papers. The protocol (protocols) marked “Corrected” shall be transported to the district election commission in accordance with the procedure prescribed by Article 93 of this Law.
We remind that according to the Article 158(3) of the Criminal Code of Ukraine, "protocol shall be written and signed on a meeting of election or referendum commission, where either the vote tabulation is being conducted, or voting, election, or referendum results are being determined. Writing or signing of a protocol in other circumstances, or inclusion of obviously false data in it shall be punished with deprivation of liberty for five to seven years with no right to hold the certain positions or be involved into the certain activities from one to three years.
